This method brings full and maximum protection. It is the recognized method in the Egyptian law for transferring real estate ownership; however it has some serious Disadvantages. For instance You are not entitled to resell, nor rent the property unless 5 years have passed since the date of purchase, and even then you would need to obtain a written approval from the Prime Minister.
Moreover Foreigners cannot buy more than several pieces of real-estate, which cannot exceed 4,000 square meters (sq. m.), and their purpose must be for a family member to live in the property. The purchase must have the approval of the Council of Ministers, which takes around two months.
The overall procedure also is much more complex and long than the Signature Court Validity( not less than 12/15 months)
The Signature Court Validity
Nowadays this is the most common and most efficient way for foreigners ( Residents or non-Residents in Egypt) to enforce their ownership on their Real Estate Property and make it official facing the authorities and/or any third party.
Basically, once the sale is completed, ie once the buyer has paid the full price of the property to the developer, the purchase contract signed by both parties at the time of the reservation is submitted to the competent Court in order to get the stamp from the judge, which will confirm the validity of the transaction and the ownership of the buyer over the property.
The main benefit of this procedure is the complete absence of any restriction for the buyer, who can own as many Real Estate Units in Egypt as he wants, who can resale or rent these properties whenever and to whoever he wants…
A Power of attorney would need to be granted to a lawyer for him to carry out on behalf of the owner the legal procedure aiming to the approval of this Signature Court Validity.
The main advantages of the Signature Court Validity is to allow the buyer to own as many Units as he wants and to resale and/or rent them without any restriction and without any prior approval.
It is Also also quite straight forward since the normal timescale to obtain the contract stamped from the court fluctuate between four to six months maximum.
